Times of Malta editorial highlights the importance of effective Ombudsman oversight

A Times of Malta editorial has focused on the role of the Office of the Ombudsman in promoting accountability, good administration and democratic governance, while drawing attention to the importance of meaningful follow up when recommendations are made.

The editorial refers to the Office of the Ombudsman as one of the institutions that plays an important role in ensuring that shortcomings within the public administration are identified and addressed. It recalls that the Organisation for Economic Co-operation and Development has described Ombudsman institutions as important pillars of open government, integrity, accountability, administrative justice and democratic governance.

It also recalls the warning by Parliamentary Ombudsman Judge Joseph Zammit McKeon that an oversight institution risks becoming merely “decorative” if its findings are not properly considered or acted upon.

The editorial further highlights the principle that, while the Ombudsman does not have coercive powers to enforce recommendations, public authorities are expected to engage seriously with the Office’s conclusions and, where they disagree, to provide clear and reasoned explanations that can themselves be subject to scrutiny.

Reference is also made to the Ombudsman’s proposal for stronger parliamentary scrutiny of recommendations that remain unimplemented, as well as to recent cases showing how the work of the Office addresses practical issues that directly affect persons in their dealings with public authorities.

The Office of the Ombudsman has consistently maintained that good administration requires more than the formal existence of oversight institutions. It also requires a public administration that is prepared to listen, explain, correct shortcomings where necessary and engage constructively with independent scrutiny.

As the Ombudsplan for 2027 underlines, public officials carry an obligation of good governance. Effective accountability therefore depends not only on identifying shortcomings, but also on ensuring that findings are properly considered and that recommendations are followed by meaningful action.
