On 17 December 2024, the United Nations General Assembly adopted the resolution titled "The Role of Ombudsman and Mediator Institutions in the Promotion and Protection of Human Rights, Good Governance, and the Rule of Law."
Key Highlights of the Resolution
Recognition of Ombudsman Institutions' Role
The resolution reaffirms that Ombudsman and mediator institutions play a significant role in promoting and protecting human rights, enhancing good governance, and upholding the rule of law. It acknowledges their capacity to address systemic issues, resolve public grievances, and foster trust in public administration.
Global Collaboration and Support
The resolution underscores the importance of international cooperation, urging Member States to strengthen Ombudsman institutions, ensure their independence, and provide adequate resources. It highlights the value of collaboration with global networks, such as the International Ombudsman Institute (IOI) and the Association of Mediterranean Ombudsmen (AOM), for which the Malta Ombudsman serves as Secretary General and Treasurer, to share best practices and enhance institutional resilience.
Emphasis on Institutional Independence
A key focus of the resolution is the financial and administrative independence of Ombudsman institutions. It calls for protection against political interference and reprisals, ensuring these institutions can effectively fulfil their mandates.
Focus on the Venice Principles
The resolution emphasises the Venice Principles, which set the foundational standards for the protection and promotion of Ombudsman institutions globally, further strengthening their role and integrity.
Connection to Sustainable Development Goals (SDGs)
The resolution links the work of Ombudsman institutions to the achievement of Sustainable Development Goal 16. This goal focuses on fostering effective, accountable, and inclusive institutions, aligning with the broader agenda of human rights and governance.
Relevance for Malta
The resolution serves as a significant international acknowledgment of the pivotal role Ombudsman institutions play in governance and human rights advocacy. It supports the ongoing efforts of the Office of the Ombudsman in Malta to broaden its mandate and evolve into a National Human Rights Institution (NHRI) in accordance with the Paris Principles.
The recognition outlined in the resolution strengthens the case for Malta to establish an NHRI and highlights how an Ombudsman institution, with an expanded remit, can effectively fulfil this role. By integrating NHRI functions into the existing framework of the Office of the Ombudsman, Malta can enhance transparency, accountability, and the promotion of human rights while leveraging the institution's established infrastructure and public trust.
As the Office of the Ombudsman in Malta continues its advocacy for an NHRI, this resolution reinforces the institution’s potential to align with international standards and contribute to a stronger, more inclusive governance framework in Malta.
