The European Union Agency for Fundamental Rights (FRA), in cooperation with the European Court of Human Rights and the Council of Europe, has published the fourth edition of the Handbook on European Law Relating to Asylum, Borders and Immigration.
The handbook provides a comprehensive overview of the legal framework governing asylum, migration and border management across Europe. It is intended as a practical reference for judges, lawyers, prosecutors, border officials, migration authorities, national human rights institutions, ombudsman institutions, civil society organisations and others working in the field.
The publication explains how issues relating to asylum, immigration and border management are regulated under European Union law, the European Convention on Human Rights, the European Social Charter and other Council of Europe instruments. By presenting the relevant legal frameworks side by side, the handbook enables practitioners to identify areas where the two systems converge and where they differ.
The handbook comes at a particularly important moment as European Union Member States prepare for the full implementation of the EU Pact on Migration and Asylum. It provides guidance on a wide range of subjects, including access to territory, asylum procedures, border management, reception conditions, detention, return procedures, family reunification, protection of vulnerable persons, and safeguards against discrimination.
A recurring theme throughout the publication is that migration management and border control must always be implemented in accordance with fundamental rights and the rule of law. The handbook highlights the importance of procedural safeguards, effective remedies, access to justice and independent oversight mechanisms in ensuring compliance with European and international human rights standards.
Particular attention is given to the rights of children, victims of trafficking, persons with disabilities and other vulnerable groups. The handbook also examines the legal standards governing detention and restrictions on liberty, emphasising that any such measures must be lawful, necessary and proportionate.
The publication further underlines the importance of independent monitoring and accountability mechanisms, recognising their role in safeguarding fundamental rights and promoting public confidence in migration systems.
As European countries continue to implement the Migration and Asylum Pact, the handbook serves as an important resource for ensuring that operational measures are accompanied by effective human rights safeguards and oversight.
